Terms of Service

These terms govern your use of Castly. By creating an account or using the service, you agree to them. We've kept them plain, with no surprises after payment.

1. Agreement

Castly is operated by DawnForge Studios ("we", "us"). By accessing or using Castly (the "service"), you ("you") agree to these Terms of Service and to our Privacy Policy. If you use the service on behalf of an organisation, you confirm you are authorised to bind it.

2. The service

Castly compiles hand-built HTML/CSS (and approved public URLs) into native, editable Elementor templates, with a visual fidelity report. The output is standard Elementor JSON you own and can edit freely.

Castly is a conversion tool, not a website builder, hosting service, or AI content generator. Fidelity is high but not guaranteed pixel-perfect; we measure and publish typical scores (around 90%+), every compile self-validates, and anything needing manual attention is listed in the handoff report. You are responsible for reviewing output before you publish it.

3. Accounts

  • Provide accurate information and keep your password and API key confidential; you are responsible for activity under your account.
  • One free account per person; creating multiple free accounts to bypass credit limits is not permitted.
  • You must be able to form a binding contract in your jurisdiction.

4. Acceptable use & your content

  • You must own or have the right to use any code, content, or URL you submit for conversion.
  • Do not submit unlawful, infringing, or malicious content, and do not use Castly to build anything unlawful.
  • Do not attempt to overwhelm, probe, or circumvent the engine's limits (rate limits and concurrency caps apply).
  • Preserved JavaScript: some effects are preserved as custom code that runs on your published page. Only import and publish output whose source you trust; you are responsible for code you choose to publish.
  • You retain all rights to the source you submit; you grant us only the limited, temporary right to process it in order to produce your output (see the Privacy Policy).

5. Credits, plans & billing

  • 1 credit = 1 page conversion. A large or complex page may cost 2–3 credits, and the exact cost is always shown before you compile.
  • Paid plans include a monthly credit allowance (Starter 20, Pro 100, Agency 400) that resets each billing period; the Free plan includes 3 credits/month.
  • When you run out, nothing is charged automatically; you choose to buy a top-up pack (25 credits for $29) or upgrade. Paid plans may also enable pay-as-you-go extra credits ($2.50 Starter / $1.50 Pro / $1.00 Agency each).
  • Subscriptions are billed in advance (monthly, or annually at a discount) through our payment processor, Stripe, and renew automatically until cancelled.
  • You can cancel anytime from your account settings; access continues until the end of the paid period. Enterprise terms are set by separate agreement.
  • Prices are in USD and exclusive of taxes, which are calculated at checkout where applicable.

6. Refunds

  • Technical failures are refunded automatically: if a conversion fails for a technical reason, the credit is returned to your balance.
  • 14-day refund on your first subscription payment: if Castly isn't for you, contact us within 14 days of your first charge for a full refund of that payment.
  • Because you preview the result and fidelity score before exporting, already-consumed pay-as-you-go credits are non-refundable.

7. Intellectual property

You own your input and the Elementor output Castly produces from it. We own the Castly software, engine, website, and brand. These terms grant you no rights in our software beyond using the hosted service.

8. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that output will be pixel-perfect, error-free, or uninterrupted.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. You agree to indemnify us against claims arising from content you submit or publish in breach of these terms.

10. Termination

You may stop using Castly and delete your account at any time. We may suspend or terminate an account that breaches these terms or that we reasonably believe poses a security or legal risk. On termination your right to use the service ends; sections that by their nature survive (IP, disclaimers, liability) continue to apply.

11. Changes, governing law & contact

We may update these terms as the product evolves; the "last updated" date reflects the current version and material changes will be communicated in-app or by email. These terms are governed by the laws of the jurisdiction in which DawnForge Studios is established, without regard to conflict-of-law rules. Questions? Use the contact page.
